THE Director of Secondary Education,Haryana filed an affidavit in the Punjab and Haryana High Court on Thursday during the resumed hearing of a contempt petition filed by Vijay Pal Singh and residents of Sector 7,Panchkula,against the director for not implementing the order dated December 16,2011 passed by the High Court for restraining the Management of Ajay Memorial School from running a primary or high school in the sector,since the plot was allotted to the school by HUDA only for running a nursery school.
While deciding on the petition (PIL) filed by Sector-7 residents,the High Court had on December 16,2011 directed the director to examine the request of the Management of Ajay Memorial School for upgrading it from nursery to fifth standard. The director was asked to keep in mind various factors including any resulting inconvenience and hardship to local residents.
The petitioners in the contempt petition stated that while the director failed to pass any order in compliance with the HC order,the school started running a primary school at the site by changing the name from Ajay Memorial School to Tulips School. The director,in his affidavit,stated that the school management,instead of submitting a representation for permission for upgradation,had started the school by changing its name.
The director stated that the recognition granted to the management should be withdrawn,since under Rule 42 of Haryana School Education Rules,2003,in case the management of school changes its name without permission from competent authority,its recognition is liable to be withdrawn.
The director issued a show cause notice to the management of Ajay Memorial School on August 14. The contempt petition will now come up for resumed hearing on December 11.
