Even as UT Estate office continues to issue fresh notices of demolitions on charges of misuse and for rampant violations in building bylaws in the city,thousands of other violators after having served notices at least two decades ago,are yet to face any resumption or demolition. Courtesy the vast number of pending cases and long drawn legal tussles between the EO and the residents.
Presently,the UT Estate office has a backlog of thousands of cases both of commercial and residential properties in the city,cases which have been pending in the court of Assistant Estate Officer for many years.
A testimony to this is the notices of demolition served to hotels in some of the most prominent sectors of the city including around 15 in Sector 35 and another 10 in Sector 22 in 1988. Some of the violations are extra rooms which were not a part of the building plans submitted to the EO.
However,till date no action has followed the notices of misuse and violations,and since then the number of violators has gone up significantly and so has the violations.
Sources say that in 1988,when these notices were served,the hoteliers had moved the court of AEO and then went on to the then Finance Secretary and then to the UT Advisors court who then sent the matter back to the AEO suggesting that there should be separate control over the hotels. This suggestion gave the hoteliers major leverage.
However,the suggestion was not taken as it would encourage more violations and it was decided that the violations of the hotel would be demolished. However,even after over 23 years,no action has been taken as yet.
