M&M directed to repair car for free

Automaker Mahindra & Mahindra Limited in Mumbai and its authorised dealer in Chandigarh Industrial Area,Swami Automobiles Private Limited,have been jointly directed to service a car for free,following a complaint by its owner to the UT Consumer Forum.

Ram Pal,who now resides in New Delhi,had alleged in his complaint,last year,that within one month of purchase of the car,it started rusting due to a manufacturing defect. He further alleged that the repairs demanded by him were not carried out by the dealer.

According to the complainant,due to manufacturing defect,the bonnet of the vehicle began rusting on the inside and outside within a month of its purchase,following which it was taken to the dealer for repair. The bonnet was repainted,but after a month of repainting the car,the body,chassis and engine of the vehicle started rusting. The complainant took the vehicle for inspection to the company,who agreed to replace the body shell of the vehicle as well as to carry out an anti-rust treatment of its chassis.

However,the Forum ruled that the rust on the body and chassis of the vehicle could be held to be a manufacturing defect and,thus,directed the company to repair the vehicle free of cost,within a period of 30 days. There is no order regarding the compensation or litigation costs.
