In its reply to the Central Administrative Tribunal (CAT),the Haryana government today said that former deputy commissioner of Panchkula,Rajinder Kataria,was transferred on the directions of the Election Commission.
The reply was filed in the wake of an application challenging his transfer was filed by Kataria a fortnight ago. Notices were issued to the Election Commission (EC),Haryana,and the new Panchkula DC Pankaj Yadav,on April 9 by the Tribunal.
While the Haryana government and Yadav filed their replies,the EC sought time to file its response.
The Haryana government also stated that Kataria was given a clean chit in the two complaints filed against him. The government placed on record the report of the Chief Electoral Officer which had held Kataria innocent. The government also submitted that Kataria was performing his duties honestly.
As per the Election Commission guidelines,an officer can only be transferred on three grounds if he is posted in his home district,if he has remained posted on the same post for more than three years or is going to complete three years by May this year or if in the past he has been shifted during previous elections on the directions of the Election Commission.
Katarias counsel,Advocate G S Bal,had maintained that in Katarias case,none of the three guidelines were applicable. He added that no showcause notices were given to Kataria before announcing his transfer. The case will come up for hearing on April 27.
