HC stays further proceedings against Punjabi actor-singer Gippy Grewal

The Punjab and Haryana High Court has stayed further proceedings against Punjabi actor, producer and singer, Rupinder Singh Grewal alias Gippy Grewal, in an alleged case pertaining to cheating and Section 45 of the Prize Chits and Money Circulation Schemes (Banning) Act.

The petitioner Grewal had moved the HC seeking quashing of the April 20 order passed by Additional Chief Judicial Magistrate, Bathinda.

Grewal was named an additional accused under Section 319 CrPC in a case registered at Canal Colony Bhatinda police station on November 5, 2014.

Grewal’s counsels senior advocate RS Rai and advocate Gautam Dutt contended that the petitioner is neither a shareholder in the company in which investment was made by the complainant nor has the petitioner launched any scheme of the company, as such.

The petitioner has attended a function organised by the company to celebrate its already-achieved success. Therefore, the petitioner is not responsible for any wrongdoing in the business of the company, the lawyers argued.

It was further contended that the lower court has passed the order in a mechanical manner without even applying its mind to the condition pre-requisite for summoning a person as an additional accused under Section 319 CrPC.

“In the meantime, further proceedings qua the petitioner only shall remain stayed”, ordered the HC.

“However, the interim order shall not be construed to be a stay against the proceedings qua other accused, in any manner, whatsoever…It is clarified that trial court shall proceed with the trial de hors the consequences of the order impugned in the present petition,” the HC order read.
