Justice Ajai Lamba of the Punjab and Haryana High Court has issued notices to the state of Punjab on an application filed by Inspector Sukhjeet Singh Virk of Punjab Police seeking directions to hand over investigation of a case to the CBI.
The petitioner had moved the High Court demanding implementation of the police chiefs order to remove anomalies in the promotion of non-gazetted officers assistant sub-inspectors to inspectors. The order was passed by the Director General of Police (DGP),Punjab,on December 23 last year.
On September 16,the High Court had ordered an inquiry by the home secretary,but this was not done. Through his counsel Anil Pal Singh Shergill,the petitioner moved an application demanding that the investigation be handed over to the CBI as the home secretary instead of conducting the inquiry,wrongly promoted seven DSPs as SPs in an utter contempt of the High Courts direction,despite a blanket ban and stay on promotions. The High Court has directed the home secretary to file an affidavit on or before December 2 in response to the notice.
