The Punjab and Haryana High Court on Wednesday dismissed petitions demanding a stay on municipal corporation (MC) elections in Amritsar and Jalandhar.
The petitioners,in three different pleas,were demanding a stay on the MC elections on the ground that prior to the elections,delimitation should be held according to the latest Census. The petitions had also demanded reservation of wards and preparation of electoral rolls.
Arguing before a division bench headed by Justice Hemant Gupta,Punjab law officer Sandeep Moudgil contested the petitions and said: The definition of population will be taken into account after the Census is published. He added that the Census report has not been published as of now and that delimitation of wards is no ground to stay MC elections.
Moudgil further submitted that the court cannot interfere once the election process has been set in motion.
Voting is a legal right but uniformity of voting is not practically possible to perfect, he argued. He also apprised the court that the Punjab government has already notified the Election Commission about the elections.
The Election Commission,however,is yet to announce the election dates.
