Dental clinic, insurer ordered to pay Rs 1 lakh compensation for negligence

The District Consumer Disputes Redressal Commission has directed Dr Sanjay Kalra’s Multi-Speciality Dental Clinic and its insurance company to compensate a patient for medical negligence and deficiency in service.
The case was filed by Manpreet Gill, who visited the clinic on October 24, 2020. Three days later, during a wisdom tooth extraction, his jaw was fractured. The doctors failed to detect the fracture at the time, causing severe pain and forcing him to seek treatment at PGIMER, Chandigarh.
The commission found that the doctors had not taken necessary precautions during the surgery and ignored Gill’s repeated complaints. Even an X-ray, which could have revealed the fracture earlier, was delayed.
Holding the clinic, doctor, and their insurer jointly liable, the commission ordered a refund of Rs 7,500 (surgery fee), Rs 10,000 for PGI treatment, 9% annual interest on both amounts, Rs 75,000 for mental agony and Rs 5,500 towards litigation costs.
The commission observed that negligence in healthcare cannot be excused. “Doctors and insurance companies are legally accountable to ensure justice for patients,” it said.
