The Punjab Consumer Disputes Redressal Commission has directed Sant Longowal Institute of Engineering and Technology (SLIET) to refund Rs 17,325 to an engineering student who had deposited the entire fee but did not attend the course.
The order was issued on a complaint filed by Amit Narang,a resident of Sirsa,against SLIET,Longowal. In his complaint,Amit said he had taken admission in the degree course for welding mechanical engineering at the institute in 2001 and deposited Rs 30,210 for the purpose. Since he chose not to join the course,he demanded a refund of his money. The institute,however,refunded only Rs 3,000 to him.
Amit then moved the Consumer Disputes Redressal Forum,Sangrur,seeking a refund of the entire money. The forum directed the institute to refund Rs 17,325 to the student,with interest at the rate of 12 per cent per annum. Challenging the order,the institute filed an appeal in the commission.
Commission president Justice S N Aggarwal and members Lt Col Darshan Singh (Retd) and Inderjit Kaushik observed that as per the terms and conditions in the prospectus,Rs 9,885 was not recoverable. However,the prospectus was silent regarding the refund of Rs 17,325. This amount had been charged towards tuition fee,computer development fund and other sundry charges. Amit told the court that the institute had 40 seats for the course and it gave admission to 42 students,which meant the institute had filled the seat vacated by him and had not suffered any loss due to his not joining the course.
The commission agreed with his contention and directed the institute to refund Rs 17,325 to him,along with costs of Rs 1,500 for the harassment caused to him. The commission reduced the rate of interest to six per cent.
