Citing medical reasons such as undergoing “chemotherapies” for cancer treatment, former Chandigarh MP Kirron Kher has moved an application in the Chandigarh district court seeking to record her statement through video conferencing (VC), as she does not intend to proceed further against Chandigarh-based businessman Chaittnya Aggarwal.

The matter is scheduled for hearing on June 12. Aggarwal had been booked in an FIR registered on December 16, 2023, under sections of cheating and criminal breach of trust of the IPC on the complaint of Kher, who alleged that Aggarwal had cheated her of Rs 6 crore out of the Rs 8 crore she entrusted to him for investment.

The Chandigarh Police has already filed a cancellation report against Aggarwal in the district court.

In her application filed before the court of Rahul Garg, Additional Chief Judicial Magistrate, Kher through her counsel has sought to record her statement through video conference saying she agrees with the cancellation report and does not intend to proceed further against the accused.

Kher’s application mentioned that now the present matter has been amicably settled with the accused whereby he has returned the entire outstanding amount to her and nothing is due against him. So, she does not intend to proceed further against the accused.

Citing medical reasons for recording her statement through VC, Kher said that she is unable to physically appear before this court for the reason that she is suffering from chronic disease, which is cancer, and is “undergoing chemotherapies” in Fortis Hospital, Mohali, which has made her health so deteriorated, and even the doctors have advised her not to go outside and to take rest in order to recover from the disease.

Mentioning the orders of the apex court and the Punjab and Haryana High Court, whereby it has been stated that evidence of any party to any proceeding may be recorded through video conference in a fit case, Kher submitted through her counsel that the present case is a fit case where the complainant is unable to physically appear before the court.

“Even otherwise no prejudice would be caused to the accused or the prosecution in case the present application is allowed and the complainant (Kher) is permitted to record her statement through video-conferencing qua the fact that she agrees with cancellation report filed by the prosecution,” mentioned Kher in the application.
