CBI to move apex court for transfer of case

The Central Bureau of Investigation (CBI) has decided to move the apex court,demanding the transfer of the main case of the J&K sex scandal,which is presently being heard in a sessions court in Srinagar.

The Central Bureau of Investigation (CBI) has decided to move the apex court,demanding the transfer of the main case of the J&K sex scandal,which is presently being heard in a sessions court in Srinagar.

The CBI will also be demanding a concurrent hearing of call the six cases which are presently under trial in a special CBI Court here.

CBI had requested the special court to adjourn the case for two months in order to move the Supreme Court. However,the court declined the application and has listed the case on June 4 for next hearing.

Public Prosecutor RK Handa said,“We want the case which is under trial in the Sessions Court of Srinagar to be shifted here as the evidences recorded in that case are important for all the cases here as well”.

“The case has been pending for seven years and the accused are at liberty to get speedy justice. The findings in the cases being heard in this court are independent of other cases. So the application moved by the investigating agency is dismissed,” reads the order passed by the special CBI court on Friday.

The witnesses which had to be examined on Friday failed to appear as the summons were not served to any one of them. Four witnesses had to be examined by the court. While the addresses of three of them were incorrect,the fourth witness,who is a government employee,is on leave till mid-May.

The main accused,Sabeena and Abdul Hamid Bhullah,also moved an exemption petition on medical grounds.

Also,three applications were moved in the case on December 19 last year,March 7 and April 4 pertaining to summons of a prosecution witness who is one of the victims,for cross examination.

The court has ordered the investigating agency to submit a reply to the application dated April 4 on the next hearing and has ordered the arguments on the three applications.
