CBI lays probe record before special court

The Central Bureau of Investigation today placed on record the fresh investigation conducted by it in the infamous judge-bribery case owing to which the prosecution sanction against Justice Nirmal Yadav was granted by the President.

The Central Bureau of Investigation (CBI) today placed on record the fresh investigation conducted by it in the infamous judge-bribery case owing to which the prosecution sanction against Justice (retd) Nirmal Yadav was granted by the President. On the last date of hearing,March 4,the premier investigating agency had filed a chargesheet against Justice Yadav in the Special CBI Court of Ritu Tagore. The agency had sought time to produce the investigation conducted by it.

The record contains call details between the accused involved in the case,CDs and statements of witnesses. As per available information,a bunch of as many as 126 documents was placed on record by the CBI. As per sources,the CBI has also produced the documents pertaining to Solan land deal.

The Court of Special CBI Judge Ritu Tagore adjourned the case to April 11 to scrutinise the documents placed on record by the investigating agency.

Meanwhile,defence counsel for Ravinder Singh and other accused debated on the issue of discharge of the accused. The court remarked that this was not the right stage to contend on the issue of discharge since the court is yet to scrutinise the official file.

On March 4 — the day she had retired as Uttarakhand High Court Judge — the CBI had filed a chargesheet against Yadav.

The other four named in the chargesheet are Advocate Sanjiv Bansal,also former Additional Advocate General of Haryana; Delhi businessman Ravinder Singh; Nirmal Singh and Rajiv Gupta.

While Justice Yadav has been chargesheeted under sections 11 and 12 of the Prevention of Corruption (PC) Act,Sanjiv Bansal,Rajiv Gupta and Ravinder Singh have been chargesheeted under Section 12 of the PC Act. Nirmal Singh alone has been chargesheeted under Section 193 read with Section 192,196 and 199 of the PC Act.

The case had rocked the Punjab and Haryana High Court after Rs 15 lakh was wrongly delivered at the residence of Justice Nirmaljit Kaur,another judge of the High Court here,on August 13,2008 following which she reported the matter to the Chandigarh Police. The money was said to have been delivered there due to confusion over names.

Justice Yadav was a sitting High Court Judge of Punjab and Haryana High Court when the scam had surfaced. Later,she was transferred to Uttarakhand High Court.

Both the Chandigarh Police,which initially investigated the case,and the CBI,which was handed over the investigation,had made it clear that the money was meant for Justice Yadav.
