After fighting his case for 17 years,an engineer working at the Rail Coach Factory (RCF),Kapurthala,was finally able to get his due promotion and pending arrears. The RCF paid Rs 1.35 lakh and also Rs 10,000 as litigation cost to the senior section engineer,Brij Mohan,after the Supreme Court recently dismissed its special leave petition,challenging an order of High Court given in favour of Brij. Since 1993,the engineer said,he had fought seven cases in the Central Administrative Tribunal (CAT),the Punjab and Haryana High Court and the Supreme Court,to get his due promotions,which he had been denied since 1992. In its order,the division bench of Justice M M Kumar and Justice Jitendra Chohan of the Punjab and Haryana High Court had even said the petitioner,RCF,could have easily avoided the filing of a petition in the court,terming it ill advised and frivolous piece of litigation. But it still went ahead and moved the apex court. The arguments by Additional Solicitor General Mohan Jain before the SC division bench of Justice D K Jain and Justice H L Dattu,however,held no ground and the SLP was dismissed. Brij Mohan said he had already written to the general manager of RCF to fix responsibility of the official who had deliberately harassed him and also led the RCF to fight an unnecessary case.
