The court upheld the ACB case that the accused had demanded a one per cent kickback from the contractor for clearing the payments. (Representational Photo) A Mahisagar court Friday sentenced two government officials to five years’ imprisonment along with a fine of Rs 80,000 in a 2016 bribery case.
In 2016, two officers of the irrigation department of Lunawada taluka of Mahisagar, Anil Kumar Tailor and Karan Kumar Patel, demanded a bribe of Rs 1 lakh from the complainant, Pushottam Patel, who was a contractor for a waste management project of a lake in Varghari village.
According to the Anti-Corruption Bureau’s case, Purshottam Patel had bagged the contract and work order through an online tender for Rs 28.99 lakh and had raised a total estimate of Rs 19.91 lakh for the work that was to be paid in installments.
The court upheld the ACB case that the accused had demanded a one per cent kickback from the contractor for clearing the payments. When the first payment of Rs 5 lakh was made to the contractor, the accused demanded Rs 25,000. However, when the contractor did not pay the amount, the accused withheld the next payment due to the contractor of the balance amount. When the contractor approached the accused for the payment to be released, they demanded Rs. 1.09 lakh.
The Lunavada Sessions Judge HA Dave convicted the accused for a period of five years, citing various orders of the Supreme Court and the Gujarat High Court in cases under the Prevention of Corruption Act, 1988.
