A local court in Vadodara on Friday granted bail to three men arrested for the December 25 near-mishap at the Royal Mela in Lalbaug area, in which three children were thrown off mid-air after the doors of the cabin they were seated in opened during a ride.
The men, booked and arrested on Thursday for alleged negligence and endangering personal safety of others, were produced in the court on Friday and granted bail.
The three men — Royal Mela organiser Nilesh Turkhiya, manager Hemraj More, and operator of the amusement ride, Yunus Mohammad – were booked and arrested by the Raopura police on Thursday.
Even as the police await a report of the City Ride Safety and Inspection Committee, primary investigation has revealed that the organisers had set up more than 22 amusement rides in the fair as against a permission for 13. The committee was set up to implement The Gujarat Amusement Rides and Gaming Zone Activity Safety Rules, laid down by the state government in July this year, following the May 25 Rajkot TRP game zone fire tragedy.
Raopura Police Inspector A A Vaghela said, “The committee report is awaited and probe is on. The court has granted bail to the three accused persons as the sections (they were arrested under) are bailable offences.”
The accused were booked and arrested under Bharatiya Nyaya Sanhita (BNS) Sections 125 (act endangering life or personal safety of others), and 289 (negligent conduct with respect to machinery).
On Wednesday, an FIR was lodged at Raopura police station against the mela organiser, manager and ride operator based on the complaint of Vadodara resident Jayesh Bhaliya, whose four-year-old son was among the children who fell from the ride.
In his complaint, Bhaliya alleged that the speed of the ride had increased suddenly after the first three rotations as the operator turned on the levers and then escaped when the cabin doors opened.
