Sohrabuddin case: Brother sends notice to BJP leaders

According to Rubabuddin and his advocate Rajesh Mankad,the statements of state BJP leaders amounted to “interference in the administration of justice” and “contempt of court” as the CBI was working on the orders of the SC.

The notice by Rubabuddin has asked the BJP leaders to reply within a period of seven days or face contempt proceedings to be initiated against them.

Rubabuddin is fighting the Sohrabuddin Sheikh fake enounter case in the Supreme Court.

The three leaders had made remarks against the CBI after the arrest of IPS officer Abhay Chudasama. The BJP leaders had said at a media briefing that the UPA government was “misusing the CBI as an instrument to tarnish the image of the Gujarat government the case”.

Rubabuddin said that these instruments were intended to obstruct the administration of justice because CBI was handed over the investigation in the case after the state police failed to tackle the case properly. He said the Supreme Court had made these observations on January 12,2010 when it transferred the case through due legal process to the CBI,after hearing the Gujarat government’s advocate.

Sohrabuddin was killed in an encounter on the outskirts of Ahmedabad in November 2005 by a team of Gujarat and Rajasthan Police. His wife Kausar Bi was also killed subsequently,but her body was never found. These facts have been admitted in investigations by the state CID (crime) as well.

CBI must probe Prajapati case as well,says Sohrabuddin Sheikh’s brother
Rubabuddin Sheikh has demanded that CID (crime) should stop investigating the Tulsiram Prajapati fake encounter case and the CBI should take over probe.

Rubabuddin told The Sunday Express from his native village in Madhya Pradesh that both the fake encounters were linked and the same agency should investigate them to find the truth and punish the guilty.

He said investigation conducted by the Gujarat CID (crime) in the Prajapati encounter case did not progress in the last two years. He said that the Gujarat Police began arresting the accused only after the CBI was handed over the probe. It arrested Abhay Chudasama only recently.

“Why did the CID (crime) not make the arrest earlier when they knew that the accused was involved in the case?” he asked.
