Principal’s service termination: Tribunal asked to give verdict by August 30

The Gujarat High Court has recently directed the Gujarat Affiliated Colleges Services Tribunal to give its verdict by August 30 on a petition filed by the principal of a Khambhat-based college,challenging his termination from the institute.

Justice M R Shah gave the order on a petition of Vijay Trivedi,challenging the order of the Tribunal of not giving him interim relief of staying the order of his termination till the final verdict.

According to the case details,Trivedi was appointed as the principal of B D Rao College,Khambhat in 2007 on probation for one year. Later,his probation period was extended till April 2009. And,at the end of the said probation period,he was terminated as the principal of the college.

He challenged his termination in the Tribunal with a prayer that he be reinstated in the college and the order of the college authorities be quashed and set aside. Trivedi had also urged that as an interim relief,he should be kept the principal and the order of his termination be stayed till the Tribunal gives its final verdict. Tribunal Judge K Trivedi,however,rejected the appeal in June.

Following this,he approached the HC. Although the court denied quashing the order of the Tribunal,it observed,“…the learned tribunal is directed to decide and dispose of the petition on or before 30/8/2009…”

Giving direction to the Tribunal for reporting the compliance of its order,the court observed,“In the facts and circumstances of the case,the learned tribunal is directed to decide and dispose of the petition without fail and report the compliance of the same before this court.”

Earlier in May,Trivedi had approached the HC challenging the order of the college authorities.

In his petition,Trivedi had said that he had the alternate remedy to approach the GACST. Though,he had added that as the sole member of the GACST (K Trivedi) was on leave and the charge of the said tribunal was not given to anybody,he had no other alternative but to approach the High Court. Following this,charge of the tribunal was given to the Gujarat University Services Tribunal judge.
