Ode case: Public prosecutors quit

Public Prosecutor C H Desai and his son Manan Desai,who was assisting him in the case,formally submitted their resignations to the Special Investigation Team,which is probing the case. The case has been “partly heard” and the investigating agencies are probing further to collect more evidence.

The family members of the victims said they would make a special request to the SIT not to accept the resignation as the case is at crucial juncture and it would take long time for the new PP to understand the case.

Earlier,R K Shah and Nayna Bhatt,who were handling the Gulberg case,and Nigam Shukla,who was handling the Naroda Gam case,had withdrawn from the two cases.

“We have formally informed the SIT,the legal department and also the local judge about our resignation in which we have cited ‘domestic’ reason. My mother has not been keeping well for some time now and her health was deteriorating. Ode is a case that requires a lot of attention. We were giving a lot of time to the case and in the process,my mother’s health was ignored. Now,it is becoming impossible for us to ignore her health and that is why we took the decision to resign,” Manan Desai told The Indian Express.

The victims,however,alleged the PP has resigned just to delay the legal process and that they would approach the SIT to re-consider the resignation.

“We don’t know when the new PP will be appointed and even if the appointment is made on a priority basis,the new lawyer would certainly not understand the case the way Desai would have. We are going to meet and request Desai. We are also going to request the SIT not to accept his resignation as we have been waiting for the justice for years,” said Anwar Malek,who lost 17 of his family members in the ghastly incident that took place on March 1,2002 in which 27 persons were burnt alive.
