A division bench of the Gujarat High Court has upheld a Gujarat Universities Services Tribunals verdict ordering the M S University authorities in Vadodara to provide conveyance allowance to the teaching staff of the Faculty of Technology & Engineering at par with the other faculties of the university like arts,law,commerce etc.
The university had been paying conveyance allowance to the teaching staff of all the faculties from 1998 till 2005. In March 2005,the university stopped paying conveyance allowance to the teaching staff of the Faculty of Technology & Engineering following a circular by the state education department,which said that the employees of grant-in-aid institutions cannot be extended transport allowance at par with government employees. The state government argued that if the benefits and facilities which are given to the government servants are extended to grant-in-aid institutions,there would not be any difference between the two.
The state governments decision was challenged by two teachers from the Faculty of Technology & Engineering at the tribunal. Representing the two petitioners,advocate Sona Sagar argued that if the allowance is granted for other faculties falling under University Grants Commission,the members of the Faculty of Technology & Engineering falling under All India Council for Technical Education (AICTE) are similarly placed and so they too should be granted the conveyance allowance. Upholding the petitioners arguments,the tribunal had held that the state governments decision violated petitioners constitutional rights and directed the authorities to pay arrears to all the faculty members at 10 per cent interest.
M S University is the only grant-in-aid university in Gujarat having the Faculty of Technology & Engineering. The state government had challenged the tribunals judgment at the High Court. However,the appeal was rejected by a single-judge bench.
The state government then preferred an appeal in the Division Bench,which recently rejected it,while upholding the tribunals order.
