The Special POTA Court on Friday rejected the bail application of one of the accused in the ISI conspiracy case. The conspiracy was allegedly hatched by the Pakistani Intelligence to avenge the killings of Muslims in the Gujarat riots. Javed Habibullah Siddiqui,the accused,had sought bail for a month,as he wanted to get married on June 2. Siddiqui,who has been in the Sabarmati Central Jail since 2003,had moved the bail application through his lawyer,Iliyas Pathan,who relied on a Supreme Court order. The apex court had released one Javed Khan,brother of gangster Sharif Khan,on bail for 15 days for his marriage. Pathan contended that Siddiqui is a divorcee and has two children,and that the marriage will ensure that his new wife took care of the children in Mumbai. The government lawyer objected to this,saying the accused had got invitation cards of his marriage with a 19-year old girl printed without obtaining permission of the court. The prosecution also said that Siddiqui had no evidence to prove whether he had divorced his first wife. Besides,the City Crime Branch,the investigating agency in this case,also told the court that Siddiqui is an accused in a terror conspiracy. Pathan said POTA Judge Jyotsana Yagnik rejected the application stating that the case is in its final stage and there is a possibility that the accused might jump bail.
