HC dismisses PIL seeking justice for Sarabjit Singh

The Indian prisoner in Pakistan jail who was attacked inside a jail in April and later succumbed to the injuries in May,against the Government of Pakistan.

The Gujarat High Court (HC) on Friday dismissed a public interest litigation (PIL) that had sought a direction to the Central government to approach the International Court of Justice with reference to the murder of Sarabjit Singh,the Indian prisoner in Pakistan jail who was attacked inside a jail in April and later succumbed to the injuries in May,against the Government of Pakistan.

The court dismissed the PIL,while holding that the issue is not covered under its jurisdiction and that for such an issue NGOs,NHRC and group of activists or citizens may approach the Central government for a remedy.

The PIL was moved by an HC advocate,Girish Das. Sarabjit was allegedly attacked by five to six prisoners inside a jail in Lahore on April 26. He remained comatose for around a week and was declared dead on May 2. According to Das,Singh’s body was sent to India by Pakistan and on performing post morterm,some of his vital organs were found to be missing. So the real cause of death could not be ascertained.

Das had sought a direction to the Centre to approach the ICJ to make sure the investigation into Singh’s murder,to ascertain as to who removed the vital organs from his body and to find out commission of other connected offences like inhuman torture because of his race,colour,language,religion,nationality,etc prohibited under international treaties and under Universal Declaration of Human Rights.
