Son of an accused in the 2002 Gulberg Society massacre case on Friday sought bail for his father from the Gujarat High Court, arguing when Maya Kodnani could be released even after being convicted for her role in the Naroda Patiya riot, an undertrial prisoner should also be granted relief.
After hearing the arguments of key accused Naran Tank’s son Mahendra, who appeared before the court in person, a bench headed by Acting Chief Justice V M Sahai reportedly asked the petitioner to approach it through a proper channel and also directed senior lawyer Vijay Patel to act as amicus curiae in the matter. Naran is in prison since 2008 and his bail petitions have been rejected on several occasions.

Laying grounds for his father’s regular bail, Mahendra reportedly cited examples of Maya Kodnani, her personal assistant Kirpalsingh Chhabda and actor Salman Khan, who all have been granted bail despite their conviction in various cases.
While Kodnani, a former BJP state minister sentenced to 28 years in jail in the Naroda Patiya riot case, was granted bail due to her ill-health, Chhabda was given relief on grounds of parity. The convictions of Salman Khan, held guilty in black buck poaching and hit-and-run cases, have been suspended by higher courts.
Later speaking to The Indian Express, Mahendra said: “It’s been over seven years since my father is in jail. The trial has been completed thrice, but no judgement was passed since there is a stay from the Supreme Court. It doesn’t make any difference to the case if my father is released on bail… My father’s bail applications have been rejected by the courts on a number of occasions. And so, I approached the High Court in this manner, because even the convicts in the Naroda Patiya case are out on bail.”
Advocate Vijay Patel, when contacted over the development, said, “Yes, I have been appointed by the Acting CJ as an amicus curiae. I have received the papers, but I am yet to go through it.”
