Gujarat HC admits plea for permission to prosecute state fisheries minister

The Gujarat High Court on Tuesday admitted a petition whereby a state government decision to deny sanction to prosecute Minister of State,Parshottam Solanki,under the provisions of the Prevention of Corruption Act has been challenged.

The Gujarat High Court on Tuesday admitted a petition whereby a state government decision to deny sanction to prosecute Minister of State (Fisheries),Parshottam Solanki,under the provisions of the Prevention of Corruption Act has been challenged. Further hearing on the petition has been kept for March 20.

The petition has been moved by one Ishaaq Maradia. According to Maradia’s lawyer Mukul Sinha,the state government had given fishing contracts for different water bodies across the state without floating any tender and that has caused huge loss to the public ex-chequer.

Holding Solanki responsible for the same,Sinha said they had moved an application before the state government seeking mandatory permission to prosecute Solanki,holding him responsible for the loss to the public ex-chequer.

Though,when the state government did not decide his application in time,Maradia approached HC. And the state government told the court that they would decide the application in three months.

However,when the decision was not taken again in time,Maradia moved a contempt petition against the state government.

And replying to the contempt petition,the state government informed that they have already dismissed the application seeking sanction to prosecute the state minister in December,2010.

This decision of the state government has been challenged at the HC by Maradia and the petition has been admitted by the court,according to Sinha.
