Frivolous plea: HC asks UP lawyer to deposit Rs 1-lakh fine

A division bench of the Gujarat High Court Thursday asked Lucknow-based lawyer Ashok Pande to deposit with the HC registry by Monday Rs 1 lakh imposed on him as cost by the Supreme Court for moving a frivolous petition.

A division bench of the Gujarat High Court Thursday asked Lucknow-based lawyer Ashok Pande to deposit with the HC registry by Monday Rs 1 lakh imposed on him as cost by the Supreme Court for moving a frivolous petition.

Last year,Pande had moved a public interest litigation in HC seeking a direction to the Centre to recall Kamla Beniwal as the Governor of Gujarat. The HC had dismissed the petition and imposed a fine of Rs 25,000 on him.

Pande had challenged the order in the SC,which dismissed his petition and imposed a cost of Rs 1 lakh on him for moving a frivolous petition. After he failed to deposit the amount with the HC registry,the court issued a non-bailable warrant against him following which he was arrested from Lucknow and produced before an HC judge at his residence. Pande then deposited Rs 25,000 with the registry and was released. However,he has not deposited Rs 1 lakh.
