In a new development in the 2008 dummy writers scam,the Gujarat High Court has ordered the investigating officers from the police and education departments to remain present before the court on Monday to explain the steps they have taken in their respective investigation.

The scam had come to light last year when two students,Harsh Kotak and Komal Patel,were found pretending an orthopedic injury and using dummy writers for the Class XII board examination of science stream.

Recently,Education Department’s under secretary S M Gamit had filed an affidavit before the Division Bench of Chief Justice S J Mukhopadhyay and Justice M S Shah.

In the affidavit,it was stated that the department had chargesheeted two of its officers — H N Chavda and M C Doshi — following the recommendations of the Vigilance Commission. Both Chavda and Doshi were facing allegations of dereliction of duty.

Earlier,one of the members of the Gujarat University’s Executive Council had filed a petition in the High Court praying departmental steps against the culprit officers. Simultaneously,a criminal complaint was also lodged with the Gujarat University police station against the erring officers. But the concerned investigating officer closed the case after filing a summary report.

Court reprimands education dept

During the hearing,the Chief Justice took a tough stand against the Education department,which had shown a considerable delay in taking steps against the erring officers in the scam.

In fact,Chief Justice Mukhopadhyay questioned the policy of providing dummy writers in the board examination and asked the lawyer of the Gujarat Secondary Higher Secondary Education Board if any board in India is adopting the similar practice.

He also asked as to why the board didn’t cancel the affiliation of the erring schools in the scam to set an example against such irregularity.
