The Porbandar district and sessions court, which is hearing an appeal by state’s Water Resources Minister Babu Bokhiria against his conviction in an illegal mining case,on Saturday rejected a plea by an RTI activist who had sought to join the case as a party.

Bokhiria and three of his relatives, among them a former Congress MP,were pronounced guilty by the court of chief judicial magistrate CV Pandya on June 15 and sentenced to three years in prison. The four had moved the sessions court on June 17 seeking a stay against their conviction.

The RTI activist,Dilip Kataria from Amreli district, too had moved the sessions court the same day pleading he be allowed to join as a party since his similar plea was pending with the Gujarat High Court.

Seeking further investigation in the case,Kataria had last year filed an application in a magistrate’s court, which had rejected the same. The activist had later moved the HC.

Meanwhile,Bokhiria’s lawyers today completed their arguments seeking a stay on his conviction.

The prosecution will present its arguments on July 16,the date of next hearing in the case.
