AAP MLA released from jail on temporary bail to attend Gujarat Assembly session

Chaitar Vasava will return to the Vadodara Central Jail on September 10 after the Monsoon Session ends

Aam Aadmi Party (AAP) Dediapada MLA Chaitar Vasava was released from Vadodara Central Jail on Monday to attend the Gujarat Assembly’s three-day Monsoon Session, following temporary bail granted by the Narmada Sessions Court last week.

In his undertaking to the Gujarat High Court, while seeking modifications in the bail conditions put by Narmada Sessions Court regarding police escort, Vasava had stated that he would stay at Gandhinagar and not enter the district of Narmada — where the alleged attempt to murder case has been lodged against him.

Chaitar also submitted to the court that while being on temporary bail he “shall not address the media or make any statements before the media… also not conduct any gathering”. The Gujarat High Court considered the case and allowed the modification to the Sessions Court order, allowing Chaitar to be enlarged on the temporary bail without police escort if he “abides by the statements” made by his lawyer in court.

On Monday, even as his supporters and AAP leaders arrived to meet Chaitar outside the Vadodara Central Jail, the MLA exchanged pleasantries and left without making a statement.

According to the bail conditions, Chaitar will attend the Monsoon Session and return to the Vadodara Central Jail on September 10 after the session ends. Chaitar’s interim bail comes nearly two months after he was arrested on July 5 in an alleged case of attempt to murder lodged by  Dediapada taluka BJP president Sanjay Vasava, after a physical brawl during a meeting at the Dediapada Prant office. The High Court will hear his plea for regular bail on September 11.

The FIR against Chaitar is lodged under the Bharatiya Nyaya Sanhita (BNS) Sections 109(1) (attempt to murder), 79, 115(2), 118(1), 351(3), 352, and 324(3). Chaitar’s plea in the Narmada court comes while his plea for regular bail in the Gujarat High Court is pending, following three adjournments. The HC was to hear the plea on August 28 but since the Gujarat High Court Advocates’ Association (GHCAA) had resolved to abstain from work protesting against the recommendation of the Supreme Court Collegium to transfer Justice Sandeep Bhatt from the Gujarat HC to Madhya Pradesh HC, Chaitar’s plea was adjourned once again in the absence of an advocate.
