Delhi HC dismisses PIL challenging Patent Chief’s appointment

The Delhi High Court has dismissed a public interest litigation (PIL) challenging the appointment of Unnat Pandit as the Controller General of Patents, Designs and TradeMarks.

“It is noted that the present writ petition has been filed as a Public Interest Litigation involving a service matter. In the given circumstances, we do not consider it apposite to entertain the present petition any further. The same is accordingly closed,” a bench headed by Acting Chief Justice Vibhu Bakhru said in an order dated December 18.

The All India Patent Officers Welfare Association (AIPOWA) had moved the court seeking quashing of Pandit’s appointment on the grounds that the recommendation by a Search Committee did not comply with the “mandate of law” and that the process of appointment was arbitrary.

The HC order cited guidelines of the Supreme Court that bar admitting PIL on certain categories, including “service matters and those pertaining to pension and gratuity.” The petitioners had argued that Unnat Pandit’s appointment was ineligible as he did not meet the requirement of a minimum of five Annual Confidential Reports (ACRs) necessary for deputation to the post of Controller General of Patents, Designs and TradeMarks.
