For,a house located in Sector 11-A,Chandigarh,was sold to two different individuals less than ten days apart by a property dealer without the house owners knowledge. The house owner,Ajay Nehra,a professor of urology,has been living in the US with his family for over 15 years. The case drew serious attention from the Punjab and Haryana High Court today when the anticipatory bail application of Pishora Singh Kapoor,an Ambala-based property dealer,came up for hearing. After hearing the arguments at length,the court dismissed the bail plea. Submitting that such a fraud could not take place without the active connivance of employees of the UT Estate Office (EO) and property dealers,senior standing counsel for UT Administration Anupam Gupta demanded action against those EO employees who gave the no-objection certificate (NOC) for the sale deed in the case. The sheer audacity of this crime is startling. There are gangs of property dealers who conduct reconnaissance of the city to find out which properties are physically unoccupied, said Gupta. He added: I have no doubt that EO employees are in collusion with property dealers in all incidents wherein unoccupied property is sold off to unsuspecting residents. It is possible that officers of the sub-registrars office are also involved. Gupta expressed shock at the speed with which the NOC was issued by the Estate Office in the present case less than a month. The Estate Office is known for raising a million objections. After a persons death,when relatives apply for NOCs,the employees put up a million hurdles to drive people mad, added Gupta. Taking note of the fact that no employee of the Estate Office has been named in the FIR,Justice Rajesh Bindal questioned as to why no action has been taken against the staff till date. In the FIR registered by the Chandigarh Police,advocate M L Gupta is named as an accused. Gupta had identified the person who claimed to be Ajay Nehra in the sale deed. Nehras signatures have been forged in the documents. The court also took exception to the fact that Gupta has not been arrested till date. It is a sad reflection of my fraternity, said Gupta referring to M L Guptas role in the fraud.
