Joint Commissioner of Police (Crime) Himanshu Roy may have to give an explanation to the the Bombay High Court if his men make no headway in tracing an absconding accused who attacked social activist Shamim Modi on July 23,2009.
Modi,a professor at the Tata Institute of Social Sciences (TISS),had to get nearly 200 stitches and suffered multiple fractures after a watchman of her building allegedly slit her throat. She had moved the High Court in 2009 alleging that the investigations made by the police were tardy and the accused were not charged under Section 307 (attempt to murder) by the investigating agency. The court has given the Crime Branch two weeks to nab the accused.
In October 2009,the probe was handed over to the Crime Branch by the HC. On Tuesday,a Division Bench of Justice B H Marlapalle and Justice U D Salvi were,however,unhappy to learn that despite taking over investigations the Crime Branch had still not found the accused. It appears to be a conspiracy. Why else would a watchman try to kill her (Modi), the court observed. If you are not able to trace the accused then we direct the chief of the Crime Branch to appear before us, Justice Marlapalle said.
Modi also sought action against a former Madhya Pradesh revenue minister and BJP leader Kamal Patel in connection with the attack on her at Vasai on July 23,2009. Modi,a social activist,earlier worked amongst mill workers in Madhya Pradesh and had contested election against him before joining TISS.
