Now Naz files review plea against SC order on gay sex

It was petition by Naz that Delhi High Court in 2009 decriminalised consensual gay sex in private.

NAZ Foundation, the NGO that spearheads the legal battle against criminilisation of gay sex,on Tuesday moved the Supreme Court, seeking review of the courts verdict on validity of Section 377 of the IPC. The NGO contended that the Supreme Court judgment on retention of Section 377 in its present form amounted to violation of fundamental rights of the Lesbian,Gay,Bisexual and Transgenders (LGBT) community.

It was on a petition by this NGO that the Delhi High Court had in 2009 decriminalised consensual gay sex in private. In the review petition, which follows a similar plea from the Centre, the NGO has pleaded for immediate stay of the December 11 judgment. It submitted that there are a number of grave errors of law and wrong application of law in the judgment, which need to be corrected.
