Shivani murder case: HC to record lawyer’s statement in-camera

Lawyer Arora submitted to bench that he wanted to justify his criticism of the judge.

The Delhi High Court today decided to record lawyer Ashok Arora’s statement in-camera before adjudicating if it should begin contempt of court proceedings against him for criticising a judge who set aside the conviction of senior IPS officer R K Sharma in journalist Shivani Bhatnagar murder case.

A Division bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw decided to record Arora’s statement in-camera after he submitted to the bench that he wanted to justify his criticism of the judge though he did not want to hurt him.

Arora made the submission to the court in response to its query if he wanted to “justify what he has done” by posting allegedly offensive and defamatory write up on his website,criticising the judge and imputing motive to him for letting off Sharma.

The lawyer also pointed out to the court that despite the court order some websites have displayed the content of the petition and sought the court to issue a notice against them.

The bench asked the police to remove the article from the websites immediately.

Earlier,the court had directed the police to stop the circulation and remove the article from the website of the lawyer.

The court was acting on a PIL filed by advocate Manish Kaushik seeking initiation of criminal contempt proceedings against Arora for writing an article on his website.

Arora had written the article after the verdict was delivered by justices Badar Durrez Ahmed and Manmohan Singh on October 17.
