Guj HC rejects plea seeking stay to 2002 Gulburg riot trial

The petition had been filed challenging the November 18 order of the trial court.

Gujarat High court today rejected the plea of some of the victims of 2002 Gulburg Society violence that trial in the case be stayed till the special investigation team (SIT) submitted final report before the trial court.

The petition had been filed by Rupa Dara Mody and others,challenging the November 18 order of the trial court rejecting the plea for stay and further investigation.

Justice J C Upadhyay today rejected the petition,and hoped that the SIT would submit its final report in true spirit in the concerned court,as directed by the Supreme

court.

Petitioners had contended that unless all the evidence collected by the SIT was submitted,trial would suffer.

Petition also said that SIT had probed the complaint of Zakia Jaffery on the direction of the apex Court,which included aspects relevant to Gulburg case,and demanded that those findings be placed before the trial court.

Untill SIT placed its final report before a magisterial court,and copy was placed before the trial court,trial should not go on,petition said.

Judge B J Dhandha of the trial court had rejected the plea of stay earlier,observing that Supreme Court had stayed pronouncement of judgement,but not asked not to continue with the trial.
