Should the marks obtained by a candidate in a subject in which he applies for undergraduate programme be the sole criteria to get admission in the Delhi University?
The Delhi High Court today agreed to look into the issue if a candidate approaches it challenging the admission procedure for undergraduate programme of the Central University which takes admission on the basis of average marks obtained by students in three subjects.
A bench headed by the Chief Justice Deepak Mishra, however, refused to hear a PIL filed by an advocate on this issue saying that the petitioner has no locus standi in the case but added that it would consider the case if students approached the court.
“We cannot entertain the PIL. Let the student approach the court. The aggrieved person should approach the court through guardian and the petitioner cannot espouse the cause of students. It is open to the student to approach the court,” the bench said.
The bench passed the order on a PIL filed by an advocate Sunil Kumar challenging the criteria followed by the University for admission in undergraduate programme.
He pleaded before the court that a student is taught only one subject in detail in graduation and other two are not main subject and so the admission should be granted only on the basis of marks obtained by a candidate in that subject in 10+2.
The court, however, refused to entertain the PIL saying that it would hear the case if an aggrieved student approaches it.
