Promotor of controversial Adarsh Housing Society,K L Gidwani,arrested by CBI for his alleged role in the multi-crore housing scam,was today remanded to police custody till March 26 by a special court here.
Three other co-accused — retired Major General A R Kumar,retired Major General T K Kaul and Secretary (Expenditure),Ministry of Finance,Government of Maharashtra Pradeep Vyas — who were also arrested by CBI — were sent to police custody till March 31.
The CBI pressed for 14-day police custody of Gidwani but the court sent him to custody only for four days as his lawyers Sirish Gupte and Satish Maneshinde cited a supreme court judgement contending that when CBI had arrested him in Adarsh corruption case where he along with his son were held for trying to bribe a CBI counsel for diluting the case,the agency should have revealed that he is under probe in the main case.
The probe agency also contended in the court that Maj Gen (retd) Kumar was working as GOC Maharashtra,Gujarat and Goa areas and he dishonestly and fraudulently,in conspiracy with former defence estates officer and Adarsh Secretary,R C Thakur and others got issued purported NOC for the plot of land applied by the Society which was in occupation of the Army since long.
CBI alleged that this was in the knowledge of Kumar for which he was not competent. As a result of NOC,the said land was allotted in favour of Adarsh Society.
