The Delhi High Court on Friday granted bail to former Army officer Lt Gen (retd) Tejinder Singh, who has been accused of offering Rs 14 crore as bribe to the then Army Chief to influence the 2010 Tatra truck deal.
Singh was arrested on Monday after the special CBI court took cognizance of the chargesheet filed in the case. He had then filed a bail plea in the Delhi High Court.
The court of Justice Pratibha Rani, in its order on Friday, noted that the trial court decision to deny bail to Singh was “against the settled legal principles laid down by this court and the apex court…”
Singh has been granted bail on a bond of Rs 1 lakh, with a surety of the same amount. He has also been restrained from leaving the country without prior permission of the court.
The court has noted that Singh, who was number two in the Army hierarchy at the time of his retirement, had not been accused of attempting to influence any witnesses in the case, nor had been arrested at any point during the investigation.
“At no stage, the CBI expressed its apprehension that the petitioner is abusing his position or exploiting his links with his ex-colleagues or had made any attempt to influence the witnesses or tamper with the evidence…” the court noted.
“Since the reasons recorded by learned special judge, while dismissing the application of the petitioner for grant of bail are against the settled legal principles laid down by this court and apex court as discussed above, I am of the considered view that petitioner deserves to be enlarged on bail,” the court held.
