High Court seeks affidavit in Kalani case

The order came after Ganesh Gole, lawyer for petitioner Sunil Sukhramani, pointed out that though CID had arrested Omie,it was not investigating the case further.

A division Bench of the Bombay High Court (HC) comprising justices V M Kanade and P D Kode asked CID on Wednesday to file an affidavit by September 25 on the progress of investigation in a case of alleged assault by Omie, son of former MLA Pappu Kalani.

The order came after Ganesh Gole, lawyer for petitioner Sunil Sukhramani, pointed out that though CID had arrested Omie,it was not investigating the case further.

Justice Kanade noted,“When it is not necessary, you [police put people in jail. But in serious cases such as this, police do not do anything. This is the problem.”

Sukhramani has accused Omie of attacking him to dissuade his aunt Neetu from contesting election from a ward in Ulhasnagar.

The judges further said police should keep in mind what picture they present of themselves before society.

Sukhramani approached the court after CID did not arrest Omie even after his anticipatory bail was rejected. HC had severely criticised CID on August 21 for delaying Omie’s arrest, saying the matter highlighted a “sorry state of affairs”. Barely two days later,CID arrested the accused.
