Two cops arrested for death of Srinagar teen in 2010

On January 31, 2010, a tear smoke shell fired by the police had killed the teen which sparked series of protests in the Valley.

Two policemen including an officer were arrested in a five year old killing of a 15-year-old teen, Wamiq Farooq, in the old city.

Last week, Forest Magistrate B A Munshi had issued arrest warrants against two policemen involved in the killing of student.

On November 21, Forest Magistrate had directed Senior Superintendent of Police to present accused cops before the court on December 1.

On Tuesday, when the accused cops were presented before the Forest Magistrate he sent both the cops to judicial custody.

“I am of the opinion that the accused persons are involved in the heinous offence and also of public importance therefore accused persons can’t be released on bail at this stage. Since the offence under section 304 (II) RPC is exclusive triable by the Court of Sessions as such the complaint in hand is committed to the court Principal Sessions Judge for further order,” reads the order.

On Nov 21 Forest Magistrate in his orders had stated that the commission of offence under Section 299 of the RPC punishable under Section 304 (part II) of the RPC has been disclosed against the accused and the process has been issued against them already.

In May CJM Srinagar had directed SSP Srinagar to constitute two teams for executing the arrest warrant against the accused cops. On August 22, 2013, Chief Judicial Magistrate Srinagar had issued non-bailable arrest warrants

Last week fresh non-bailable arrest warrants were issued against Asst. Sub Inspector Abdul Khaliq Sofi and Special Police Officer (SPO) Mohammad Akram.

On January 31, 2010, a tear smoke shell fired by the police had killed a Class VII student who according to his family was on way to attend tuition. The death of student sparked series of protests in the Valley.

Soon after the killing the then Inspector General of Police, Farooq Ahmad ordered a probe and suspended a policeman accused of firing the tear smoke shell that hit the student.

To seek justice, Wamiq’s father moved to the court. The Chief Judicial Magistrate (CJM) of Srinagar ordered a magisterial inquiry by the Small Causes Judge. While family members of Wamiq Farooq blamed the police for killing the student without any provocation and even identified the accused cops, but police in its defense termed the young boy as a miscreant.
