The Supreme Court Wednesday agreed to hear a petition seeking registration of a fresh FIR against Bahujan Samaj Party (BSP) chief Mayawati in a corruption case even though CBI said her name has already been cleared by other agencies.
A bench of Justices A R Dave and A K Goel said it would not pass any immediate order in the case but would later hear in detail the petition filed by former BSP member Kamlesh Verma.
The court’s observation came although Attorney General Mukul Rohatgi, appearing for CBI, underlined that Mayawati has been cleared by the Income Tax Appellate Tribunal (ITAT) and Delhi High Court in cases linked to her alleged illegal wealth.
“Issue of donations to Mayawati had been heard by ITAT and she had been given clean chit in each case. We don’t have any other material. So why should we go on registering another FIR?” Rohatgi added. The possibility of a new FIR or complaint comes at a time when the politicians in Uttar Pradesh, including three-time CM Mayawati, are preparing for the state polls next year.

Senior advocate K K Venugopal, appearing for Mayawati, said this case was politically motivated as the petitioner was out for vendetta after being denied a ticket to contest elections. “He (Verma) did not get a BSP ticket. He lost on a Congress ticket. Since then, he is carrying out a vendetta against Mayawati,” said Venugopal.
But the bench replied: “How are we concerned with that? We have to look into the facts. We cannot overlook if there is some substance being brought before us by the petitioner.”
Petitioner Kamlesh Verma has sought registration of a new FIR based on some alleged new documents in the Taj Corridor scam case.
The apex court had in 2012 quashed a disproportionate assets case against Mayawati on a technical ground.
