Salman Khan hit-and-run case: Panchnama and site map fabricated, says defence lawyer

Justice A R Joshi was hearing the appeal of the actor, who on May 6 was convicted by a sessions court for culpable homicide not amounting to murder in the 2002 hit-and-run case in which one man had died and four were injured.

The actor’s lawyer Amit Desai, who is arguing the actor’s appeal against his sentencing in the Bombay High Court, also pointed out discrepancies in blood stains found on the tyres.

The prosecution’s case was that the actor’s white Toyota Landcruiser ran over men sleeping on a pavement in suburban Bandra on September 28, 2002.

“Evidence was made up to build a case against Khan of culpable homicide not amounting to murder under section 304 (ii) of the IPC (culpable homicide not amounting to murder, which carries a maximum punishment of 10 years),” Desai said.
“If one starts with a lie, one will end up with a lie. When we talk of justice to the victim there is equal justice to the accused also,” Desai said.

Desai, armed with maps, road measurements, and details of the accident spot, said, “They found blood on rear tyres of the car, but if the car did run over victims sleeping along the pavement, the front tyres should have had bloodstains,” he argued.

Questioning what caused the blood stains, he said: “Did it happen because of accident or the crane? There is nothing to indicate where the blood stains were (from).” A crane was brought to remove the car later.
