(file) The Supreme Court on Wednesday asked Maharashtra government to file an affidavit regarding its decision to hand over to CBI the case of lynching of two Hindu religious leaders and their driver by a mob in Palghar district in April 2020.
The petitioners told a bench of Chief Justice of India D Y Chandrachud and Justices P S Narasimha and J B Pardiwala, which took up the matter that the state had agreed for a CBI probe in the case.
The bench then asked whether CBI had agreed to it given its workload. The CBI counsel said it was in agreement to take over the probe. The court also sought to know the status of the trial against the accused. The bench asked the agency why the court should pass an order and whether the state can file an affidavit. The CJI said the court will list the matter on April 14, after the affidavit is filed. The Eknath Shinde government had, in October last year, informed the SC that it had no objection to handing over the investigation to the CBI.
