Jamia Milia Islamia University has been asked by the Delhi High Court to frame well-defined guidelines to deal with the cases of students caught using unfair means in their examinations.
Justice Hima Kohli gave this direction to the University while ticking it off for not promoting an MBA second-year student,Syed Arshad Hussain,to the next academic session on charges of using unfair means in his examination,an allegation that the institution was not able to prove.
The judge also asked the University to promote Hussain and allow him to take the final year examination.
While directing the institution to fix norms for dealing with cases of students caught cheating,Justice Kohli said,”The Vice Chancellor of the University shall ensure that requisite updated guidelines are prepared and circulated to all the personnel who shall be involved in the examination process.
“The court expresses its deep dismay and discontentment at the manner in which the University officials have handled the incident and this has also displayed the lack of application of mind on the part of the Examination Committee in scrutinising the documents related to the petitioner,” the court observed.
It referred to the alleged cheating material,recovered from the posseession of the student,but thi was not produced during the vigilance probe against him.
The court’s order came on Hussain’s appeal challenging the University decision against witholding his promotion to the next acedemic year despite the vigilance probe against him failing to prove use of unfair means by him in the examination held in January last.
