A man has been sentenced to two-year imprisonment for attacking his wife and injuring her with a kitchen knife in the heat of the moment as a Delhi court convicted him on the charge of making an unintentional bid to kill her.
The court convicted North West Delhi resident Naresh on milder charges of making an unintentional bid on his wife’s life rather than for the stringent offence of attempting to kill her with full knowledge and intention,saying the man attacked his wife with a kitchen knife and not with a dagger used by hardened criminal.
It appears the present crime had been committed by the convict (man) in the heat of the moment by a sudden surge of passion due to some misunderstanding over the character of the complainant (woman),” Additional Sessions Judge Sanjeev Aggarwal said while sentencing the man.
The intention of the accused not to cause the death of the victim is also clear from the fact that the knife used was a kitchen knife and not the knife used by hardened criminal, the court said while also imposing a fine of Rs 5,000 on him.
The court convicted Naresh on milder charges also noting that he injured his wife on her head,instead of inflicting wounds at any vital organ,such as chest,abdomen or neck,despite having an ample opportunity to do so as she was alone at home at the time of the altercation.
According to the prosecution,on March 30,2007,Naresh had gone to his wife’s maternal home,where she was staying after an altercation with her husband following doubts expressed by her husband over her fidelity.
Naresh,a farmer by profession,was married to Sushila for 24 years and had two grown up sons from her when the incident occurred.
After wounding his wife,Naresh fled the scene,leaving her in a pool of blood. She was rushed to the hospital.
Following the incident,a case was registered by the police on Sushila’s complaint alleging Naresh used to harass her and demand money from her and her parents. On refusal,he used to beat her,and that is why,he had attacked her,she alleged in the complaint.
Naresh,in his defence,said his wife had implicated him in a false case as he doubted her fidelity and because of which he did not wish to stay with her.
