Mumbai: FIR against Omkar director, 3 others

The complaint referred to the AltaMount project of the firm, a residential complex off WEH in Malad, spanning 10 acres of land. The police said the land was occupied by a slum.

The EOW has booked four persons, including an unnamed director of Omkar Real Estate Developers, for allegedly cheating the state exchequer of over Rs 400 crore, police said.

The EOW on Tuesday concluded an 18-month preliminary inquiry against Omkar Real Estate Developers, it revealed.

The inquiry was initiated after Jaynaraiyan Tiwari (35), a Malad resident, claimed that seven hutments, including his own, were encroached by the developers in 2007. Each hutment is worth about Rs 2 crore, Tiwari claimed in his complaint to the police in January 2015.

The complaint referred to the AltaMount project of the firm, a residential complex off WEH in Malad, spanning 10 acres of land.

The police said the land was occupied by a slum. “Our inquiry found that bogus consent documents were generated allowing the developers to construct over the disputed land. We found that the developers availed 8, 03, 515 sq feet of free FSI under the slum scheme. If the developers had to buy the FSI from the government, it would have cost them Rs 401.78 crore,” said an investigator .

Police have also found that a reserved cemetery space of 60,000 square feet was reduced to nearly 5,000 square feet.

In an emailed response to The Indian Express, a representative of Omkar developers said the alleged irregularities do not pertain to the developer. “The first part is about the forgery of eligibility documents filed by the slum dwellers. This complaint is against the society committee members and not against the developer. Omkar Realtors has no role to play in the eligibility issue as the matter rests between slum dwellers and the Competent Authority,” the spokesperson said.

The other complaint against Omkar and the SRA pertains to a claim by the complainant over leasehold rights on 1,000 square yards within the SRA project, the company said. “Out of 1,000 square yards, an area of 750 square yards had been further declared has been notified as Slum under Section 3 (c) of Slum Act. And the remaining area of 250 square yards has been treated as non slum plot and accordingly complied with,” the firm said.

According to the FIR, three of the accused are members of the Janu Bhoy Nagar Society. They are Gulab Gavhane (Secretary) Magan Tak (President of the society) and Pratiraj Yadav (Convenor of society). No arrests have been made so far.
