Local advocacy group Sajag Nagarik Manch has approached the state Chief Information Commissioner (CIC) with a complaint against the University of Pune (UoP),alleging that certain provisions in varsity’s newly introduced ordinance has provisions contravening the RTI Act.

In the complaint,filed under Section 18 of RTI Act,2005,the group has requested CIC Ratnakar Gaikwad to address the issue on a priority basis,highlighting that it has larger public interest and lakhs of students of the university are getting affected.

The varsity has came out with the new ordinance 184 (A) and (B) enabling students access to photocopies of assessed answersheets. Though most of the provisions in the new ordinance have been welcomed by experts,three are facing objections. The new ordinance has replaced Ordinance 182 that was termed as ‘unlawful’ for allegedly having provisions that violated the enabling principles of the RTI Act and Supreme Court ruling in related matter.

“As per newly introduced ordinance,students can seek photocopies of answersheets within 10 days of declaration of results. It states that university shall not be liable for failure or delay in providing photocopies of evaluated/re-evaluated answersheets due to any reasons beyond its control. It stipulates that examinee shall be the sole custodians of photocopies and should not transfer the same to anybody for any purpose. All these provisions are arbitrary in nature and contravene the RTI Act in matters of issuing photocopies of answersheets,” said Vivek Velankar of Sajag Nagarik Manch.

UoP authorities were not available for comments.
