He and other MNS members have been booked under IPC sections for promoting enmity between groups (153A),obstructing public officials on duty (353),committing acts endangering life and safety of others (336) and mischief causing damage (425

and 427).

MNS had taken to streets in October 2008 to protest a railway policy of advertising in newspapers in North India, instead of giving priority to “sons of the soil”. Over 100 cases were filed against Thackeray and his workers across the state.

His discharge application submitted by lawyer Sayaji Nagre contended,“He (Thackeray) was not present where the incident took place. There is no evidence to show he influenced the other accused to commit the crime.”

The prosecution said a mob of MNS members allegedly incited people with slogans such as ‘Raj Thackeray aage badho, hum tumhare saath hain. Raj ka aadesh maanana hain, exams band karna hoga’ at Chetna College in Bandra where railway recruitment examinations were conducted.
