Train passenger ordered to pay Rs 26,000 for travelling without ticket, misbehaving with TT

The 25-year-old manhandled the railway official after he refused to accept a UTS ticket’s photo.

A civil sessions court in Mumbai has ordered a local train commuter to pay a ticket checker Rs 5,000 as compensation for misbehaving with him and to pay a Rs 21,000 fine for travelling without a ticket.

The case is from February 2020, wherein a commuter travelling on a first-class Panvel-CSMT train could not produce a valid ticket and the ticket checker asked him to pay a fine. The 25-year-old showed the photo of a ticket apparently generated on the UTS (unreserved ticketing system) app. Photos of UTS tickets are not considered valid.

The man had a heated argument with the ticket checker, named Joseph Petrrappa, and manhandled him. A case was registered at the Vashi railway police station against him on charges of misbehaving with a government servant and not carrying a valid ticket.

The railway fined the passenger Rs 20,000 under IPC section 353 (assault or criminal force to deter public servant from discharge of his duty) and Rs 1,000 under the Railways Act section 147 (trespass). Out of the fine amount, Rs 5,000 is to be paid to the ticket checker as compensation under section 357 (1) (b) of the Code of Criminal Procedure.

The man was not sentenced to imprisonment considering the overall nature of the dispute and his not having any criminal background.

A Central Railway official said the judgment would deter people from misusing the UTS app.
