A day after a toddler died after falling into an open ditch on a forest land in Vikhroli,the police booked Mumbai suburban collector and deputy collector for culpable homicide not amounting to murder on Tuesday. According to Deputy Commissioner of Police (zone 7) Sanjay Shintre,an FIR was filed against suburban collector Nirmal Deshmukh and his deputy Shivaji Dhavbhat under Section 304 (Punishment for culpable homicide not amounting to murder) of the Indian Penal Code. On Monday,12-month-old Jayesh Mohite was found dead in a ditch dug by the government officials for smooth flow of water to enable growth of mangroves in the area. Police officers investigating the case said Mohit might have fallen while playing. After Mohits body was found,his parents held Deshmukh responsible for the accident and demanded his arrest. The police then booked the collector and his deputy in the case. We will record their statements and decide whether they are at fault after investigating the matter, said Shintre. He added that the parents are yet to take the custody of the childs body,which is lying in a private hospital.
