Ambedkar, who is also a lawyer, said, "Any individual in any case always gets adequate opportunity to go and appeal against court order. Unless the process is complete, status quo is maintained." (FILE)Vanchit Bahujan Aghadi president Prakash Ambedkar on Friday accused the BJP of displaying “undue haste” in disqualifying Congress leader Rahul Gandhi from holding Parliamentary membership.
The grandson of Dr B R Ambedkar said, ” As per the Surat court order, Gandhi had the right to go in appeal in a higher court. It was the right given by the judiciary.”
Had Gandhi’s appeal been upheld or rejected by a higher court then the question of exercising powers to disqualify could be considered, Ambedkar said.
“However, BJP has not allowed any process to be completed. They took hasty decisions to disqualify membership of Rahul Gandhi who was elected representative in Lok Sabha. All this smacks of politics. It is unfair to Congress leader. It is against democracratic norms,” he added.
The Surat court has convicted Gandhi over his ‘Modi surname’ remark. Gandhi made this remark during the 2019 general elections campaign.
Gandhi was found guilty in a defamation case related to the remark and sentenced to two years imprisonment. He is currently out on bail.
Ambedkar, who is also a lawyer, said, “Any individual in any case always gets adequate opportunity to go and appeal against court order. Unless the process is complete, status quo is maintained.”
Unfortunately, he argued, ” BJP’S sole concern appears to punish the rival and put them in prison. In this case, they went ahead with disqualification which is shocking.”
