Pawar seeks transfer of Munde plea against his election as MCA chief

Union Agriculture Minister and NCP chief Sharad Pawar has sought the transfer of a suit filed by senior BJP leader Gopinath Munde challenging Pawar’s election as the Mumbai Cricket Association (MCA) President, to another judge of the city civil court.

Pawar, in a letter dated January 11 to the principal judge of city civil court, stated that the suit by Munde is based on the interpretation of the provisions of the Memorandum of Association and the MCA rules.

According to Pawar, the suit filed by Munde would also involve the interpretation of the association rules. “Since the provisions have already been exhaustively interpreted by the learned trial judge, it is desirable that the suit be assigned to any other court for hearing and final disposal,” reads Pawar’s plea.

“This only goes to show that the Central minister does not have faith in the Indian judiciary,” said Munde’s lawyer Vivekanand Gupta.

The Bombay High Court had last month granted interim relief to Pawar and set aside the city civil court’s order that prevented him from functioning as president of the MCA.

Munde had challenged the rejection of his nomination to contest the biennial presidential election, terming it as illegal.

The High Court, while passing an order earlier, had said it was not inclined to consider Pawar’s plea of changing the judge. “The learned judge (of the lower court) has passed the order on the basis of available material. The (lower) court will pass the appropriate order if case is made for transferring the matter,” Justice Mohta had said.
